Welcome to Claire Cain Art ("we", "us", "our"). These Terms and Conditions ("Terms") govern your use of our website located at www.clairecain.art (the "Site") and the purchase of any original artworks, prints, or custom commissions from our studio. By accessing or using the Site, you agree to be bound by these Terms.
1. Introduction
1.1 These Terms apply to all visitors, users, and others who access or use the Site.
1.2 By using the Site, you represent and warrant that you are at least 18 years old or have the consent of a parent or guardian.
2. User Accounts
2.1 To access certain features of the Site, you may need to create an account. You agree to provide accurate, complete, and current information when creating your account.
2.2 You are responsible for maintaining the confidentiality of your account credentials and for restricting access to your device.
2.3 You agree to accept responsibility for all activities that occur under your account.
3. Purchases & Bespoke Commissions
3.1 When you place an order on the Site, you are making an offer to purchase our products. All orders are subject to acceptance by the studio.
3.2 We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, production constraints, or clear inaccuracies in product or pricing information.
3.3 Custom or bespoke commission orders are subject to a separate, collaborative timeline and milestone process, which will be outlined upon acceptance of the commission inquiry.
4. Pricing, Taxes, and Payment
4.1 All prices displayed on the Site are in Australian Dollars (AUD) and are subject to change without notice.
4.2 Claire Cain Art is a small business entity not registered for GST; therefore, GST is not applicable, and no tax is charged on purchases made through this online store.
4.3 Prices exclude shipping and handling fees, which will be clearly calculated and displayed at checkout before payment completion to prevent hidden costs.
4.4 We accept various secure payment methods as indicated on the Site. By providing payment information, you represent that you are authorised to use the selected payment method.
5. Shipping and Delivery
5.1 All orders are mindfully packaged and dispatched from our studio in Hobart, Tasmania. We make every effort to ship standard orders within our estimated timeframes; however, specific delivery dates cannot be guaranteed.
5.2 Shipping costs and estimated delivery windows will be provided at checkout based on standard or express freight networks.
5.3 We are not liable for transit delays caused by third-party shipping carriers (such as Australia Post) or international customs processing.
6. Australian Consumer Law, Returns, and Refunds
6.1 Our products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
6.2 For change-of-mind returns on standard, non-custom items, you must contact the studio within 14 days of receiving your order.
6.3 Returned products must be received back in their original, pristine, and undamaged condition and packaging before a change-of-mind refund can be processed.
7. Intellectual Property & Copyright
7.1 All content on the Site—including original artwork designs, text, images, graphics, tactile concepts, unique visual motifs, and logos—is the exclusive intellectual property of Claire Cain and is protected by Australian and international copyright laws.
7.2 The purchase of an original artwork, textile piece, or print does not transfer copyright or reproduction rights to the buyer. You may not use, reproduce, distribute, or display any content or artwork from the Site for commercial purposes without prior written permission from Claire Cain.
8. Limitation of Liability
8.1 To the maximum extent permitted by law, including the Australian Consumer Law, Claire Cain Art shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your access to or use of the Site.
9. Governing Law
9.1 These Terms, and any sales or agreements resulting from the use of this Site, are governed by and construed in accordance with the laws of the State of Tasmania, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Tasmania.
10. Changes to Terms
10.1 We reserve the right to modify or replace these Terms at any time. Material changes will be updated directly on this page.

Shipping & Returns Policy
Eco-Conscious Packaging
The protection of our natural world guides every aspect of the studio's practice. To honour this commitment to plastic reduction, all art prints are packaged in plastic-free, fully biodegradable cello sleeves, wrapped in 100% recycled tissue paper, and secured in a hard-backed envelope with an extra layer of recycled card.
Original artworks are safely backed with protective greyboard, enclosed in a biodegradable sleeve, wrapped in recycled tissue paper, and shipped flat (for sizes A4 or smaller) or carefully rolled in a heavy-duty mailing tube (for sizes A3 and larger) to ensure safe arrival.
Domestic Australian Shipping
Dispatch Times: Standard orders are prepared and dispatched from our Hobart studio within 2–5 business days. If you require an artwork urgently for a specific date, please contact the studio prior to placing your order.
Delivery Address: Please ensure your delivery address is accurate at checkout. No responsibility can be taken for items lost or misdelivered due to incorrect address entry.
Tracking: All domestic orders over $100 AUD are sent via a tracked service through Australia Post. Please provide your mobile number at checkout to receive transit notifications directly from the carrier.
International Shipping
We happily ship our art to collectors worldwide. International orders are sent via standard international air mail, with average delivery times ranging between 7–14 business days depending on the destination country.
Taxes and Customs Duty: International purchases may be subject to local import taxes, customs duties, or VAT regulations upon arrival in your country. The buyer is entirely responsible for paying these additional local customs charges.
Returns & Exchanges
Change of Mind: We want you to love living with your artwork. If you are not completely satisfied with a standard item, please notify us at hello@clairecain.art within 14 days of receipt to request a return. You then have 14 days to return the item to our Tasmanian studio.
Return Conditions: The buyer is responsible for return shipping costs. We strongly recommend using a tracked service (such as Australia Post Registered Post) as refunds can only be issued once the artwork is received back in its original, pristine condition.
Exclusions: Custom orders, bespoke commissions, and specially made-to-order framed art prints are unique creations and cannot be returned for a change of mind.
Production Partners
To lower our shipping emissions and carbon footprint, we work with trusted fine-art production partners for our largest art prints. These are produced locally to your region where possible and dispatched directly to you. Please allow a small amount of extra delivery time for these specialty items.
Damaged or Faulty Items
If an item arrives damaged or faulty, please contact Claire at hello@clairecain.art within 30 days of receipt. We will provide return instructions, cover the cost of return postage, and arrange an immediate replacement or full refund in accordance with your legal rights under the Australian Consumer Law. (Note: This excludes items explicitly purchased as "seconds" or from sample sales, though sample sale items remain eligible for standard change-of-mind returns at the buyer's shipping expense).
Shipping & Returns
PACKAGING
The environment is very important to us so all our prints are packaged in a biodegradable cello sleeve. They are then wrapped in 100% recycled tissue paper and packaged in a hard back envelope with an extra piece of recycled card for protection. Originals are packaged with a piece of grey board in a biodegradable cello sleeve, wrapped in 100% recycled tissue paper and then placed in a hard backed envelope if A4 or smaller and A3 and larger will be sent in a tube.
UK DELIVERY
Our current dispatch times are 2-5 days. Please feel free to get in touch before placing your order if you need it for a particular date.
Please take care to ensure your delivery address is entered correctly and accurately. No responsibility can be taken for orders consequently lost or sent to the wrong address.
SHIPPING WORLDWIDE
I do ship worldwide but due to the current EU import laws it means it’s easier as an EU customer to purchase my prints through my web store. However if you do purchase through this website you will be required to pay for import and custom charges before you can receive the package.
TRACKED DELIVERY
All orders over £50 will be sent with tracking in the UK. Please remember to include your mobile number for notifications from our courier. International orders are sent by standard UK air mail and delivery times average on 7-10 days but can vary. Please be aware of any additional taxes or fees your country may charge. Unfortunately we can't be responsible for items in the post but we will try to assist as much as possible. We’ll endeavour to inform you of any delay to your order.
RETURNS AND REFUNDS
You have 14 days to request a refund after receipt of the goods if you are not happy with your art (excluding custom orders/ made to order art prints and frames, please see below). Please email hello@clairecain.art to arrange the return. You will then have 14 days to return the items to us. Please note the order will only be refunded on receipt of the goods in the original condition. The buyer is responsible for returning the goods, we recommend using recorded delivery where possible. Please allow 14 days from receipt of returned goods for the refund to be processed.
CUSTOM ORDERS
We work with production partners for all our larger art prints. Please allow extra delivery time for these. They will be dispatched directly to you and where possible produced locally to you to reduce our carbon footprint.
DAMAGED OR FAULTY GOODS
If an item is faulty on receipt or develops a fault please email Claire on hello@clairecain.art within 30 days to arrange your replacement or refund. Instructions for the return will be emailed and postage will be covered for returning faulty products. Please note this excludes sample sale items that have been sold as seconds. We still offer full refunds but the buyer is responsible for returning the item.
SALE REFUNDS OR RETURNS
Reduced items and those purchased in sample sales are eligible for a full refund, please let us know within 14 days. The buyer is responsible for return postage costs and we strongly recommend a recorded delivery service such as Royal Mail Signed For. Please contact us to arrange the return and we will advise of the delivery address.
